As a graduate of the University of South Dakota Law School, but a North Dakota practicing attorney, I, Brandon Rowenhorst wanted to bring attention to the alternative pilot program to the bar exam being utilized in South Dakota because although similar attempts have failed to pass in North Dakota the fact that South Dakota is now attempting such a pilot program this issue is likely to return to North Dakota. My concerns for such a program are as follows: 

Rowenhorst Law acknowledges a potential future program within North Dakota where law school students may bypass the bar exam in favor of studying under practicing attorneys, this raises significant concerns about the integrity and effectiveness of legal education. Critics argue that this approach undermines the rigorous standards necessary for legal practice. The preparation for the bar exam serves as a crucial benchmark, as it sets a comprehensive minimum standard that generally covers the wide range of areas of knowledge confronted in the practice of law. The proposed alternative to the bar exam, which amounts to the old “read the law” admission process places an enormous amount of responsibility on the supervising attorney to actually teach. However, when law students have the opportunity to learn under practicing attorneys in law school, like through externships supervising attorneys often treat the law students like “gophers” to do grunt work such as legal research, without actually teaching. By putting so much responsibility on the supervising attorney, and some supervising attorneys may live up to the standard, but history shows that is not always the case, so such an approach is essentially lowering the standards into the admission of the practice of law. In doing so, in lieu of being of assistance to the public by creating more attorneys, more harm could actually be done by lowering the quality of legal advice being provided.
